Terms of Service

1. Acceptance of Terms

By accessing or using Systara Motion ("the Service"), operated by Systara ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. The Service is accessible at motion.systara.in.

2. Account Requirements

To use Systara Motion, you must:

  • Be at least 18 years of age or the age of legal majority in your jurisdiction
  • Provide accurate, complete, and current information during registration
  • Maintain the security of your account credentials and not share them with others
  • Promptly update your account information if it changes
  • Accept responsibility for all activities that occur under your account

3. Subscription and Billing

Pricing:Systara Motion is offered at a subscription price of ₹500 per month, plus applicable GST. Pricing is subject to change with 30 days' prior notice.

Free trial: New accounts receive a 30-day free trial with full access to all features. No payment is required during the trial period.

Auto-renewal: Your subscription automatically renews at the end of each billing cycle. You will be charged the then-current subscription fee unless you cancel before the renewal date.

Cancellation: You may cancel your subscription at any time. Upon cancellation, you will continue to have access to the Service until the end of your current billing period. See our Refund & Cancellation Policy for details.

Payment processing: All payments are processed securely through Razorpay. By subscribing, you also agree to Razorpay's terms of service.

4. Acceptable Use

You agree not to use Systara Motion to:

  • Engage in any illegal activity or violate any applicable laws or regulations
  • Scrape, crawl, or use automated tools to extract data from the platform
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Attempt to gain unauthorised access to other users' accounts or our systems
  • Transmit malware, viruses, or any other malicious code
  • Use the Service in a manner that could damage, disable, or impair its functionality
  • Resell, sublicense, or commercially redistribute access to the Service without our written consent

5. Data Ownership

You retain full ownership of all business data you enter into Systara Motion, including trip records, bilty details, financial information, and customer data. We do not claim any ownership rights over your business data. You grant us a limited licence to store, process, and display your data solely for the purpose of providing the Service to you. Upon account termination, you may request an export of your data.

6. Intellectual Property

The Systara Motion platform, including its software, design, branding, logos, documentation, and all associated intellectual property, is owned by Systara and protected by applicable intellectual property laws. Your subscription grants you a non-exclusive, non-transferable, revocable licence to use the Service for your internal business purposes. This licence does not include the right to modify, copy, distribute, or create derivative works based on the platform.

7. Limitation of Liability

To the maximum extent permitted by law, Systara shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the 12 months preceding the claim. The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free access. We do not provide a formal Service Level Agreement (SLA). The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned downtime in advance.

9. Termination

By you: You may cancel your subscription and terminate your account at any time through your dashboard settings or by contacting us at support@systara.in.

By us: We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay subscription fees. We will provide reasonable notice before termination, except in cases of serious violations.

Effect of termination: Upon termination, your right to access the Service ceases immediately. You may request an export of your business data within 30 days of termination.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in India.

11. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue legal remedies under Indian jurisdiction. Before initiating formal proceedings, you agree to contact us at support@systara.in to attempt an amicable resolution.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised terms. If you do not agree with the changes, you may cancel your subscription before the changes take effect.
